Welcome to MyHealthSentry. Please read these Terms of Service carefully before using our platform.

1. Acceptance of Terms

By accessing or using MyHealthSentry.com (the "Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the Service.

2. Description of Service

MyHealthSentry provides health monitoring, wellness tracking, and personalized health insights through our web and mobile applications. Our Service includes:

• Health risk assessments and predictions
• Integration with wearable devices and health apps
• Personalized health recommendations
• Social features including health competitions

3. User Accounts

To use certain features of the Service, you must create an account. You agree to:

• Provide accurate and complete information
• Maintain the security of your account credentials
• Notify us immediately of any unauthorized access
• Accept responsibility for all activities under your account

4. Health Information Disclaimer

IMPORTANT: MyHealthSentry is not a medical device and does not provide medical advice, diagnosis, or treatment. The information provided is for educational and informational purposes only.

• Do not disregard professional medical advice based on information from our Service
• Seek immediate medical attention for any health emergencies
• Our predictions and risk assessments are estimates and should not replace professional medical evaluation

5. User Conduct

You agree not to:

• Use the Service for any unlawful purpose
• Attempt to gain unauthorized access to our systems
• Interfere with or disrupt the Service
• Upload malicious code or content
• Impersonate others or provide false information
• Use the Service to harm, threaten, or harass others

6. Intellectual Property

All content, features, and functionality of the Service are owned by MyHealthSentry and are protected by intellectual property laws. You may not copy, modify, distribute, or create derivative works without our express written permission.

7. Third-Party Services

Our Service may integrate with or link out to third-party services, including wearable devices, health apps, donation processors, and charitable organizations. Your use of any third-party service is governed by that party's own terms and privacy policy, and access to it is at your own choice.

MyHealthSentry is not responsible for the content, security, availability, accuracy, or operation of any third-party service. We do not control, supervise, or monitor third-party websites, payment processing, donation completion, receipt issuance, charity operations, or charity content. When you click out to a third-party service from MyHealthSentry, that party — not MyHealthSentry — becomes the entity collecting any information you provide to it.

8. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, MYHEALTHSENTRY SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, OR HEALTH OUTCOMES.

9. Indemnification

You agree to indemnify, defend, and hold harmless MyHealthSentry and its officers, directors, employees, and agents from any claims, damages, losses, costs, and expenses (including reasonable attorneys' fees) arising out of or relating to:

• your use of, or inability to use, the Service;
• your violation of these Terms;
• your violation of any applicable law, regulation, or third-party right;
• any content, charity selection, charity name, logo, mark, or claim you upload, configure, or display in connection with a competition;
• any misrepresentation, false statement, or misleading fundraising or tax claim you make in connection with a charity competition;
• any unlawful contest, sweepstakes, wager, or prize-linked financial mechanic you attempt to operate through the Service; and
• any third-party rights claim arising from a competition, charity selection, or campaign you created or participated in.

10. Termination

We may terminate or suspend your account at any time for any reason, including violation of these Terms. Upon termination, your right to use the Service ceases immediately.

11. Changes to Terms

We reserve the right to modify these Terms at any time. We will notify you of material changes via email or through the Service. Continued use after changes constitutes acceptance of the new Terms.

12. Charity Competition Features

MyHealthSentry may allow competition creators to associate a competition with a charitable organization and present participants with a suggested donation amount after the competition ends. The following rules apply to every charity-linked competition on the Service.

No donation required. No donation is required to join, participate in, or complete a competition. Any suggested donation amount displayed in the Service is informational only and may be changed by you (or declined entirely) at the donation processor's site.

No pledge or payment obligation. Participation in a competition does not create a legal obligation to donate. Competition results do not create any debt, fee, penalty, or payment obligation to MyHealthSentry, the competition creator, the charity, or any other user. Suggested amounts shown during a competition (including amounts that change over time based on competition activity) are displayed for motivation only and are not pledges, stakes, or amounts owed.

Third-party processing. Donations are processed by Pledge.to or another third-party donation processor under that party's own terms of service and privacy policy. MyHealthSentry is not the merchant of record and does not receive, hold, transmit, settle, split, or control donated funds. Your payment card and billing information are collected by the processor, not by MyHealthSentry.

No charity endorsement; limited role. MyHealthSentry does not sponsor, administer, fundraise on behalf of, or guarantee any charity, except where expressly stated. The presence of a charity in the Service does not imply endorsement, affiliation, partnership, or sponsorship between MyHealthSentry and that charity unless specifically disclosed. Charity names, logos, and marks are used by the competition creator subject to that creator's representation of authorization (see Section 13).

Receipts; tax disclaimer. Donation receipts and tax documentation, if any, are issued by the processor or the recipient charity, not by MyHealthSentry. MyHealthSentry does not provide legal or tax advice and does not guarantee deductibility of any donation. Tax treatment depends on the recipient charity's status, your jurisdiction, and applicable law.

Refunds and disputes. Refunds and donation disputes are handled by the processor and/or charity under their own policies. MyHealthSentry cannot reverse, refund, or modify a completed donation.

Campaign modification and removal. MyHealthSentry may, at its sole discretion and without notice, remove a charity, disable a campaign, end or modify a competition, or suspend feature access for any reason, including legal, compliance, policy, or operational considerations.

13. Creator Conduct in Charity Competitions

If you create a competition that links to a charity, you represent and agree that you will not:

• state or imply that donations are mandatory or that participation creates a binding payment obligation;
• describe suggested amounts as pledges, stakes, fees, penalties, amounts owed, or amounts at risk;
• require a donation as a condition of joining, completing, or being eligible to win unless expressly authorized by MyHealthSentry in a legally compliant program;
• use any charity's name, logo, trademark, or other marks without that charity's express authorization;
• make false or misleading statements about how funds will be used, tax treatment, matching, affiliation, or endorsement;
• run raffles, sweepstakes, wagers, games of chance, or any prize-linked financial mechanic through the Service;
• harass, coerce, or pressure other participants into donating; or
• run a competition in any jurisdiction where applicable charitable solicitation, fundraising platform, or other law would require registration, licensure, or filings that the creator has not obtained.

MyHealthSentry may remove creator content, reject charity-linked competitions, suspend feature access for repeat offenders, and cooperate with charities, regulators, and donation processors in investigations.

14. Assumption of Risk and Release for Competitions

Competitions on the Service, including charity-linked competitions, are organized by the competition creator and participated in voluntarily by each user. To the maximum extent permitted by law:

• MyHealthSentry is not responsible for disputes between competition creators and participants, including disputes about charity selection, donation amounts, charity authorization, or post-competition donation behavior.
• MyHealthSentry does not guarantee any competition result, leaderboard accuracy, processor availability, charity acceptance of funds, charity continued operation, or donation outcome.
• You release MyHealthSentry from claims arising out of (i) any other user's conduct in a competition, (ii) the conduct, content, or availability of any third-party charity or donation processor, and (iii) any donation, attempted donation, or non-donation made in connection with the Service.

15. Compliance With Law; Restricted Jurisdictions

MyHealthSentry reserves the right, at any time and without notice, to limit or disable the Service or specific features (including charity-linked competitions) in any jurisdiction; require additional disclosures, consents, or agreements before granting access; or restrict certain charities, campaign types, payment methods, or users, in each case as MyHealthSentry deems appropriate to comply with applicable law (including but not limited to charitable solicitation registration regimes, online charitable fundraising platform requirements such as California AB 488, consumer protection law, and state lottery, gambling, sweepstakes, and contest law).

You are responsible for ensuring that your use of the Service is lawful in your jurisdiction.

16. Account Enforcement Rights

In addition to the termination right in Section 17, MyHealthSentry may:

• reject or remove any charity-linked competition or related content;
• remove unauthorized charity branding or marks;
• suspend or restrict access to one or more features (including charity-linked competitions) on a temporary or permanent basis;
• require attestation, documentation, or charity authorization before allowing certain features; and
• cooperate with charities, regulators, donation processors, and other parties in investigations or enforcement actions.

17. Termination (continued)

Without limiting Section 10, MyHealthSentry may terminate, suspend, or restrict any account, content, or feature access at any time, with or without notice, for any reason, including breach of these Terms.

18. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of Delaware, without regard to conflict of law principles.
